But for many injured workers, that \u201cRTW\u201d note can feel downright scary.<\/p><p>Maybe you\u2019re not sure if you can actually perform the tasks. Maybe your employer hasn\u2019t been the most supportive. Or maybe you just don\u2019t know what your rights and responsibilities are.<\/p><p>Let\u2019s take the fear out of it.<\/p><h2><strong><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/14.0.0\/svg\/1f4bc.svg\" alt=\"\ud83d\udcbc\" \/><\/strong><strong> What the Law Says<\/strong><\/h2><p>Under <strong>California Labor Code \u00a7\u00a7 4658, 4658.1, and 4659<\/strong>, once you\u2019ve been medically cleared for modified or regular work, your employer has an obligation to <strong>offer you work within your restrictions<\/strong> \u2014 if such work is available.<\/p><p>Similarly, <strong>Title 8 of the California Code of Regulations \u00a7 10116.9<\/strong> outlines that employers should make reasonable efforts to accommodate the injured worker\u2019s medical limitations. The treating physician\u2019s restrictions are the key.<\/p><p>However, as the injured worker (the \u201capplicant\u201d), <strong>you also have a duty<\/strong> \u2014 to make a <strong>good faith effort<\/strong> to return and perform the offered work. The Workers\u2019 Compensation Appeals Board (WCAB) and courts generally look favorably on applicants who try to comply with their doctor\u2019s release.<\/p><h2><strong><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/14.0.0\/svg\/1f9b4.svg\" alt=\"\ud83e\uddb4\" \/><\/strong><strong> If You\u2019re Afraid You Can\u2019t Do It\u2026<\/strong><\/h2><p>That\u2019s okay. Many people are nervous about reinjury or pain. The important thing is communication.<\/p><p>If you <strong>attempt to return<\/strong> and discover you can\u2019t perform the tasks safely or within your doctor\u2019s restrictions, immediately:<\/p><ol><li><strong>Report it<\/strong> to your lead, supervisor, or manager.<\/li><li><strong>Request to go back to the clinic<\/strong> for a re-evaluation.<\/li><li>The doctor can <strong>modify your work restrictions<\/strong> or <strong>take you back off work<\/strong> if medically appropriate.<\/li><\/ol><p>That\u2019s the proper way to handle it \u2014 not to avoid returning, but to <strong>document<\/strong> and <strong>seek clarification<\/strong> through the correct channels.<\/p><h2><strong><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/14.0.0\/svg\/2696.svg\" alt=\"\u2696\ufe0f\" \/><\/strong><strong> Good Faith Goes a Long Way<\/strong><\/h2><p>A \u201cgood faith effort\u201d is crucial. Showing up, trying the work, and reporting difficulties builds credibility and strengthens your case.
